This website is operated by Restup. Throughout the site, the terms “we”, “us” and “our” refer to Restup. Restup offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory of residence, or that you are the age of majority in your state or territory of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Products

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

Pricing & Payments

All prices are listed in Australian Dollars (AUD) and are inclusive of GST unless stated otherwise. We reserve the right to change prices at any time without notice, however changes will not affect orders that have already been accepted.

Payment is required in full before products are shipped. We accept the payment methods displayed at checkout. All payments are processed securely through Shopify and its authorised payment providers.

Pre-Orders & Waitlist

From time to time we may offer products on a pre-order or waitlist basis. Estimated dispatch dates for pre-order items are estimates only and may change due to manufacturing, supply chain or shipping factors outside our control.

You may cancel a pre-order at any time before it is dispatched by contacting us at support@restupofficial.com for a full refund. Joining the waitlist does not create a binding order until you complete checkout.

Order Cancellations & Changes

If you need to cancel or change an order, please contact us at support@restupofficial.com as soon as possible. We will do our best to accommodate changes before your order is dispatched. Once an order has shipped, it cannot be cancelled but may be returned in accordance with our Returns policy below.

Shipping & Delivery

We currently ship to addresses within Australia. New Zealand shipping will be available soon.

Delivery times are estimates only and commence from the date of shipping, not the date of order. Risk in the goods passes to you on delivery. We are not responsible for delays caused by the carrier, customs, weather or other events outside our reasonable control.

Returns & Refunds

Change of mind: You may return unused items in their original, undamaged packaging within 30 days of delivery for a refund or exchange. Return shipping costs for change-of-mind returns are the customer's responsibility. Refunds are processed to your original payment method within 10 business days of us receiving the returned item.

Faulty or damaged items: If your item arrives faulty, damaged or not as described, please contact us at support@restupofficial.com within a reasonable time of delivery. We will cover return shipping and provide a repair, replacement or refund in accordance with your rights under the Australian Consumer Law (see below).

To start a return, contact us at support@restupofficial.com with your order number and reason for return.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you have under the Australian Consumer Law or any other law that cannot be excluded.

Intellectual Property

All content on this website — including the Restup name and logo, product designs, images, text, graphics and layout — is owned by or licensed to Restup and is protected by Australian and international intellectual property laws.

You may not copy, reproduce, modify, distribute or commercially exploit any content from this website without our prior written consent.

Limitation of Liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, our total liability to you for any claim arising out of or in connection with these Terms or your use of our products is limited, at our option, to the resupply of the goods or the cost of resupplying the goods.

We are not liable for any indirect, incidental, special or consequential loss or damage, including loss of profits, loss of data or loss of use, arising out of or in connection with your use of our website or products.

Accuracy of Information

We are not liable if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.

Privacy

Your use of our website and Services is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
